ChickTracker Online – Terms and Conditions

Welcome to ChickTracker Online, a service operated by The Ohse Homestead (“Company”, “we”, “us”, or “our”). By accessing or using ChickTracker.com, you agree to be bound by the following Terms and Conditions.

If you do not agree to these Terms, you must not use this service.

1. Description of Service

ChickTracker Online is a web-based record keeping platform designed to assist poultry keepers, homesteads, farms, and breeders in tracking incubation data, breeder information, and hatch records.

The service is provided as a data organization and record-keeping tool only. ChickTracker does not guarantee hatch success, flock health, productivity, or business outcomes.

2. Eligibility

By using this service, you represent that:

You are at least 18 years of age
You have the authority to enter into these Terms
You will comply with all applicable laws and regulations

3. Account Responsibility

Users are responsible for:

Maintaining the confidentiality of their login credentials
All activity occurring under their account
Ensuring the accuracy of any data entered into the system

You agree to notify us immediately if you believe your account has been compromised.

4. Payments and Billing

ChickTracker subscriptions are billed on a recurring basis.

Payments are processed through Square or other third-party payment providers.

By subscribing you agree that:

You authorize recurring billing until cancelled
Payment processing is handled by third parties
We do not store full payment card information on our servers

Refunds are not guaranteed and are evaluated on a case-by-case basis.

Failure to maintain payment may result in suspension or termination of service.

5. Service Availability

While we strive to provide reliable service, ChickTracker Online is provided on an “AS IS” and “AS AVAILABLE” basis.

We do not guarantee:

Continuous uptime
Error-free operation
Uninterrupted service
Compatibility with all devices or browsers

The Company may:

Modify features
Temporarily suspend services
Perform maintenance
Update or discontinue parts of the platform

without prior notice.

6. Data Storage and Data Loss

Users acknowledge that:

ChickTracker stores user-generated data
We implement reasonable technical safeguards
No system is completely immune from failure or attack

Therefore:

Users are strongly encouraged to maintain their own backups of critical data.

The Company is not responsible for loss of data, including but not limited to:

system failures
cyberattacks
hardware issues
third-party service failures
accidental deletion

7. Data Security and Breach Disclaimer

We take reasonable steps to protect user data using commercially reasonable security practices.

However, you acknowledge that:

No internet transmission or electronic storage method is 100% secure.

The Company shall not be liable for damages arising from:

unauthorized access
hacking
cyber attacks
data breaches
third-party infrastructure compromise
credential theft by user negligence

In the event of a confirmed data incident, we will take reasonable steps to notify affected users as required by applicable law.

8. User Conduct

You agree not to:

Use the service for illegal purposes
Attempt to gain unauthorized access to the system
Upload malicious software or scripts
Disrupt service operations
Attempt to reverse engineer the platform

Violation may result in immediate termination of your account.

9. Intellectual Property

All content, design, software, branding, and intellectual property associated with ChickTracker are owned by The Ohse Homestead unless otherwise stated.

Users may not:

Copy
redistribute
reverse engineer
sell
sublicense

any portion of the platform without written permission.

10. Third-Party Services

ChickTracker may rely on third-party services including but not limited to:

Square (payment processing)
hosting providers
cloud storage
analytics tools

We are not responsible for outages, breaches, or failures caused by third-party services.

Use of those services may also be governed by their own terms.

11. Limitation of Liability

To the fullest extent permitted by law:

The Company shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to:

loss of profits
loss of livestock
business interruption
loss of data
loss of records
economic damages

arising from use of the service.

Our total liability for any claim shall not exceed the total amount paid by the user during the previous 12 months.

12. Indemnification

You agree to indemnify and hold harmless The Ohse Homestead and ChickTracker from any claims, damages, losses, or legal expenses arising from:

misuse of the service
violation of these Terms
inaccurate or unlawful data entered by users
disputes between users or third parties

13. Termination

We reserve the right to suspend or terminate accounts at our discretion for:

violation of these Terms
non-payment
abuse of the platform
actions that threaten system stability or security

Upon termination, access to stored data may be revoked.

14. Changes to the Service

We may modify:

pricing
features
service structure
subscription tiers

at any time.

Users will be notified of significant changes when possible.

Continued use of the service constitutes acceptance of those changes.

15. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Oklahoma, United States.

16. Arbitration Agreement

Any disputes arising from the use of ChickTracker shall be resolved through binding arbitration, rather than in court, except where prohibited by law.

Arbitration shall occur within the State of Oklahoma under applicable arbitration rules.

Each party shall bear its own legal costs unless otherwise determined by the arbitrator.

17. Class Action Waiver

Users agree that any dispute resolution shall occur on an individual basis.

Users waive the right to participate in:

class actions
class arbitrations
representative lawsuits

18. Privacy Policy

Use of ChickTracker is also governed by our Privacy Policy, which describes how user information is collected and used.
